[URGENT] About Labeling Liability in Goods (starting 1 July 2010)

The Ministry of Commerce (Kemendag) is accelerating the implementation of mandatory provisions for non-food goods using Indonesian labels with  effect from July 1, 2010 for import and non-imported products. Earlier in Permendag No.62/M-DAG/12/2009 about non-food product labeling, is scheduled to apply on December 21, 2010.

“There are changes from Permendag, it is taking effect July 1, 2010,” said Director of Consumer Protection Directorate General of Domestic Trade Ministry of Commerce Radu M. Sembiring when found at the Chamber office, Jakarta, Friday (9/5/2010).

Radu explained, for all new non-food products circulated as of July 1st, 2010 shall be labeled with the Indonesian language. As for non-food products which are already in circulation will be given a year to be withdrawn from circulation.

"If it is still in circulation there will be sanctions," said Radu.

He explained that the acceleration of the use of mandatory labeling Indonesian language for non-food products aims so that consumers can quickly understand the information on products purchased.

"Acceleration is purely for the protection of consumers, it’s still in socialization stage now," he explained.

As is known, Permendag No.62/M-DAG/12/2009 sets mandatory labeling of four non-food products are electronic products, parts or components, tools and building materials, and other products.

For companies who violates, will have their business licenses of trade (SIUP) revoked and subject to sanctions under consumer protection laws - Law No. 8 of 1999.

Non-food products are still found without including the label (caption) in Indonesian language. Whereas if the provisions are in Indonesian language, the consumer can find out the product information so they can be protected.
